Terms and Conditions of the 96 Power Parts Online Store
§ 1. Definitions
Terms and Conditions – these regulations specifying the rules for concluding distance sales contracts via the Online Store, the rules for executing these contracts, the rights and obligations of the parties, and the complaint procedure.
Customer – a natural person with full legal capacity, a legal person, or an organizational unit without legal personality to whom the law grants legal capacity, concluding a Distance Sales Contract with the Seller.
Consumer – a natural person performing a legal transaction with an entrepreneur not directly related to their business or professional activity.
Individual Entrepreneur – a natural person concluding a Distance Sales Contract directly related to their business activity, when the content of the contract indicates that it does not have a professional character for that person.

Online Store – the internet service run by the Seller, available at: https://96powerparts.com.
Goods – a movable item that the Customer can purchase in the Online Store.
Digital Content – data produced and delivered in digital form.
Sending the Order – confirmation of the order by clicking the "" button, treated as a binding declaration of intent to conclude a Distance Sales Contract.
§ 2. General Provisions
- The Seller provides electronic services including the sale of Goods, Account management, and adding reviews.
- Minimum technical requirements: a web browser (Chrome, Firefox, Edge) in the current version and a PDF viewing program.
- Descriptions of Goods and prices on the Store's pages constitute an invitation to conclude a contract.
§ 3. Orders
- Purchases are made by filling out the Electronic Order Form.
- Sending the form by clicking "" constitutes a binding declaration of intent to conclude a contract.
- The order fulfillment time is 1 to 10 business days from the conclusion of the contract.
§ 4. Payments
- The Store offers payment via prepayment or cash on delivery.

§ 5. Delivery
- The Customer selects the delivery method in the order form.

§ 6. Right of Withdrawal (Returns)
- A Consumer may withdraw from the contract within 14 days without giving any reason, subject to point 4 below.
- In the event of withdrawal, the Consumer bears the direct costs of returning the Goods.
- The statement of withdrawal can be submitted via the electronic form: https://96powerparts.com/en/returns-open.html.
- EXCLUSION OF THE RIGHT TO WITHDRAW: The right to withdraw from a Distance Sales Contract does NOT apply to:
a) Goods produced according to the Consumer's specifications or serving to satisfy their individual needs (Personalized Goods).
b) This applies specifically to:- Motorcycle wheels (built, laced, or trued) upon the Customer's individual order (selection of rims, hubs, spokes, nipples).
- Custom battery packs, wiring harnesses, or any other components modified or manufactured specifically at the Customer's request.
c) Sealed goods which cannot be returned for health or hygiene reasons if opened.
§ 7. Consequences of Withdrawal
- The Seller shall return all payments received, including delivery costs (cheapest standard method), within 14 days of receiving the statement.
- The Seller may withhold the refund until the Goods are received back or until proof of shipment is provided.
- The Consumer is liable for any diminished value of the Goods resulting from handling them beyond what is necessary to establish their nature and functioning.
§ 8. Complaints
- Complaints can be submitted via the form: https://96powerparts.com/en/rma-open.html or by e-mail to: contact@96powerparts.com.
- The Seller will respond to the complaint within 14 days.
- The Seller is liable for defects in the Goods existing at the time of delivery under the statutory warranty for Consumers (2 years).
§ 9. Subscriptions
- Regular deliveries are paid automatically via a linked payment card.
- The Customer can terminate the Subscription at any time via the Account or by contacting the Store.
§ 10. Final Provisions
- These terms are effective as of: 2023.04.01.
- The law applicable to resolving disputes is Polish law.
- Consumers may use out-of-court dispute resolution (ODR platform: http://ec.europa.eu/consumers/odr).
Annex No. 1 - Instructions on the Right of Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason (excluding personalized and custom-built products mentioned in § 6 point 4).

Return Costs: You will have to bear the direct cost of returning the goods. Due to the weight and dimensions of certain Goods (e.g., wheel sets, motors, batteries), the return cost may be significantly higher than standard mail and may require pallet shipping.
